Terms of Service

1. Agreement to Terms

By accessing or using RadioAura's internet radio hosting services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Use License

RadioAura grants you a personal, non-transferable, non-exclusive license to use the Service for broadcasting internet radio content, subject to these Terms.

You may not:

• Modify or copy the Service materials
• Use the Service for any commercial purpose without proper authorization
• Attempt to decompile or reverse engineer any software contained in the Service
• Remove any copyright or proprietary notations from the Service
• Transfer the Service to another person or "mirror" the materials on any other server

3. Account Registration

To use our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all responsibility for activities under your account
• Immediately notify RadioAura of any unauthorized use of your account

4. Content Guidelines

You are solely responsible for all content broadcast through your radio station. You agree that your content will not:

• Infringe on any third-party intellectual property rights
• Contain hate speech, harassment, or discriminatory content
• Include illegal, obscene, or pornographic material
• Promote violence or illegal activities
• Contain malware, viruses, or other harmful code
• Violate any local, state, national, or international law

5. Copyright and Music Licensing

You are solely responsible for obtaining all necessary licenses and permissions for any copyrighted music or content you broadcast. RadioAura does not provide music licensing. You must obtain appropriate licenses from organizations such as ASCAP, BMI, SESAC, SoundExchange, or equivalent organizations in your jurisdiction.

6. Subscription and Billing

Some aspects of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis ("Billing Cycle").

• Billing cycles are set on a monthly basis
• At the end of each Billing Cycle, your subscription will automatically renew unless you cancel it
• A valid payment method is required for paid plans
• Fees are non-refundable except as required by law

7. Free Trial

RadioAura may offer a free trial for new paid subscriptions. The free trial period lasts for 14 days unless otherwise specified. At the end of the free trial, you will be charged the applicable subscription fee unless you cancel before the trial ends.

8. Cancellation and Termination

You may cancel your subscription at any time from your account dashboard. Cancellation will take effect at the end of your current Billing Cycle.

RadioAura reserves the right to suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in fraudulent activity.

9. Service Limitations and Uptime

While RadioAura strives to provide 99.9% uptime, we do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable for any modification, suspension, or discontinuance of the Service.

10. Bandwidth and Storage Limits

Your use of the Service is subject to the bandwidth and storage limits specified in your subscription plan. If you exceed these limits, we may temporarily suspend your service or require you to upgrade to a higher plan.

11. Prohibited Uses

You may not use the Service:

• In any way that violates applicable laws or regulations
• To transmit advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate RadioAura, a RadioAura employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use of the Service
• For any automated use such as scraping or data mining
• To interfere with or circumvent the security features of the Service

12. Intellectual Property

The Service and its original content, features, and functionality are owned by RadioAura and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

14. Limitation of Liability

IN NO EVENT SHALL RADIOAURA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF YOUR ACCESS TO OR USE OF THE SERVICE.

15. Indemnification

You agree to defend, indemnify, and hold harmless RadioAura from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including copyright, property, or privacy rights; or (d) any content you broadcast through the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Canada.

17. Changes to Terms

RadioAura reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitute acceptance of the new Terms.
